          Pursuant to the Order dated 17th September, 2013, the case has been put up today as a fresh case.

          Supplementary Affidavit, sworn on 12th August, 2013 has been filed today on behalf of the petitioner.

          Learned Standing Counsel appearing for the respondent Nos. 1 to 3, on the basis of instructions received by him, states that on  the Stay Application filed on behalf of the petitioner in the Appeal before the Divisional Commissioner concerned, the Divisional Commissioner concerned by the Order dated 19th August, 2013 has prohibited fresh Appointment of Dealer in respect of the Fair Price Shop in question.

         Learned Standing Counsel has also produced a Certified Copy of the said Order dated 19th August, 2013 passed by the Divisional Commissioner concerned.

         Let the same be placed on record.

         In view of the statement made by the learned Standing Counsel appearing for the respondent Nos. 1 to 3,  Sri Neeraj Srivastava, learned counsel for the petitioner states that the present Writ Petition has become infructuous, and the same may be dismissed as such.

         In view of the statement made by Sri Neeraj Srivastava, learned counsel for the petitioner, the present Writ Petition is dismissed as having become infructuous.

          Interim order, if any, stands vacated.
