Supplementary affidavit filed today is taken on record.
Sri Arun Kumar Singh, Advocate, filed short counter affidavit after serving the copy to the learned counsel for the petitioner as well as to Sri Y.K. Yadav, learned Standing Counsel. Sri Y.K. Yadav, learned Standing Counsel, appearing on behalf of the State, who is said to be the appointing authority, has already been directed to file counter affidavit, but he stated that counter affidavit could not be made ready. He is directed that in the counter affidavit, the State Government may also inform the policy of transfer and also explain that why the transfer has been made on pick and choose basis without assigning any reason while the number of similarly situated officers are already working for more than six years.
On the request of Sri Y.K. Yadav, learned Standing Counsel, put up on 10.12.2013 as fresh to enable him to file counter affidavit.
Till the next date of listing, interim order shall continue.
