The petitioner, who is a Chief Medical Officer, posted at Fatehpur.
It appears that on a complaint of one Sri Amarjit Singh, who claimed to be the social worker, the petitioner has been suspended on 28.5.2013 and departmental inquiry proceeding has been initiated.
The contention of the petitioner is that the inquiry proceeding has been concluded and inquiry report has been submitted before the disciplinary authority for passing a final order and when final order has not been passed, the petitioner approached this Court.
On 25.10.2013, learned Standing Counsel was directed to seek instruction. He has produced the copy of the letter written by the Joint Secretary, U.P., Government dated 12.11.2013 wherein it is stated that the order of re-inquiry has been passed, which is pending for consideration.
It is unfortunate that the petitioner is a Class IV level Doctor, has been suspended on 28.5.2013 and till date the inquiry has not been concluded.
In view of the aforesaid facts and circumstances, we direct the inquiry officer to conclude the inquiry within a period of three weeks and submit the report to the disciplinary authority and the disciplinary authority, thereafter, shall pass a final order within another period of one week.
