This petition has been filed with a plea that order of this court dated 20.2.2013 rendered in W.P. No.196(SB) of 2013, Satya Prakash Saxena v. State of U.P., has not been complied with.

Respondent has not complied with the order in its letter and spirit, intentionally. Accordingly, the respondent has committed contempt of Court, as defined under Section 2(b) of the Contempt of Courts Act 1971.

Operative part of the order, noted above, reads as under:

"By the impugned order dated 12.10.2012 petitioner was suspended in contemplation of departmental enquiry.

According to petitioner's counsel in response to chargesheet petitioner had already submitted a reply and enquiry has also been concluded but disciplinary authority has not passed final order.

In view of above, we dispose of writ petition finally directing the disciplinary authority/respondents to pass a final order expeditiously, say within a period of two months from the date of receipt of a certified copy of this order and communicate the decision to the petitioner."

Issue notice to the respondent to show-cause as to why he be not proceeded against for committing contempt of Court, for 09.7.2013.

The respondent is directed to furnish explanation as to under what circumstances the order passed by this court has not been complied with, and why contempt proceedings be not initiated.

At this stage, Sri Lalit Shukla, learned Government Advocate has put in appearance on behalf of the respondent.

Copy of the petition has been given to him in the court, who has received the same on behalf of the respondent.
