This application has been filed with the plea that order of this court has been complied by way of passing order dated 18.5.2013, placed on record as Annexure CA-1. Accompanying affidavit has been filed by respondent no.2.
Learned counsel prays for recall of order dated 08.5.2013 vide which non-bailable warrant was issued for procuring presence of respondent no.2, who was not responding to the notice of this court despite repeated representations.
This court has taken note of the fact that notice was issued on 23.1.2012. More than one year went by. It is only after non-bailable warrant was issued that the order of the court has been complied with.
Considerable delay has been caused in proceedings in this case and substantial time of the court has been wasted. Needless to say that every authority, particularly, public servants are bound by duty to comply with the orders passed by a court of law.
The order dated 08.5.2013 is kept in abeyance, however, subject to the respondent no.2, Sri Hriday Ram Azad, paying costs to the tune of Rs.2000/-(Two thousand only) to Oudh Bar Association within one week from today or else the warrant would be required to be executed.
