Heard Sri Ravish Kumar Singh and Sri Mithilesh Kumar Shukla Advocate for appellants Yogendra Sri Kamlesh Kumar Advocate for appellant Jugendra and Sri Viresh Mishra learned Senior Counsel for the appellant Devendra in all the three connected Criminal Appeal Nos. 1400 of 2012, 1979 of 2012 and 1980 of 2012 and leaned AGA for the State.

After hearing all the counsel and after going through the impugned judgment as has been described at internal page 3 and other pages, we consider it appropriate to release the appellants, namely, Yogendra and Jugendra on bail as according to the own showing of the prosecution they were not caused any injury to the deceased.

Learned AGA did not dispute the aforesaid facts.

Looking to the above argument and period of detention and the fact that the appeal is not likely to be heard in near future, we consider it appropriate to release the appellants on bail.

Let the appellants, namely, Yogendra and Jugendra be enlarged on bail on their furnishing a personal bond of rupees one lakh and two sureties each in the like amount to the satisfaction of trial Judge concerned in S.T. No. 593 of 2008, under sections 302, 307, 504 and 506 I.P.C., P.S. Eka, District Firozabad.

As soon as personal and surety bonds are furnished, photocopies of the same are directed to be transmitted to this Court forthwith by trial Judge concerned to be kept on the record of this appeal.

The appellants are allowed one month time to deposit entire amount of fine awarded to them.

So far as bail prayer of appellant Devendra is concerned, it stands rejected.
