This petition has been filed with a plea that order of this court dated 04.1.2013 rendered in W.P.No.17(SS) of 2013, Atul Pandey v. State of U.P. and others, has been violated. Respondent has not complied with the order in its letter and spirit, intentionally. Accordingly, the respondent has committed contempt of Court, as defined under Section 2(b) of the Contempt of Courts Act 1971.
Operative part of the order, noted above, reads as under:
"However, considering the peculiar facts and circumstances of the case, the opposite party No.2 is directed to consider the case of the petitioner in the light of Rule 13 (5) and the subsequent consent of opposite party No.6, if it is legally possible, expeditiously.
With these observations the petition is finally disposed of."
Issue notice to the respondent to show-cause as to why he be not proceeded against for committing contempt of Court, for 04.7.2013.
The respondent is directed to furnish explanation as to under what circumstances the order passed by this court has not been complied with, and why contempt proceedings be not initiated.
At this stage, Sri H.S. Jain, Advocate has put in appearance on behalf of the respondent.
Copy of the petition has been given to him in the court, who has received the same on behalf of the respondent.
