Heard learned counsel for the petitioner.

By this writ petition, the petitioner has prayed for quashing the order dated 25th February, 2013 passed by the Sub Divisional Officer by which the petitioner's fair price shop has been cancelled.

Against the order cancelling the fair fair price shop agreement, the petitioner has remedy of appeal under Clause 28 of the U.P. Distribution of Scheduled Commodities Control Order, 2004. There being remedy of appeal, we are not inclined to entertain the writ petition. However, in case petitioner files an appeal within two weeks from today along with the stay application, till the stay application is considered, no fresh allotment of the shop in question shall be made, if not already made.

With the aforesaid observation, the writ petition is disposed of.
