In Criminal Misc. Delay Condonation Application No. 270356 of 2011

Heard Sri Mukhtar Alam for the appellant Anwar @ Chhotu.

Appellant has challenged the impugned judgment of conviction and sentence dated 11.2.2011 passed by Additional Sessions Judge/ Special Judge, E.C. Act, Fatehpur in S.T. No. 635 of 2003 under Section 302/34 I.P.C., P.S. Kotwali, District Fatehpur whereby appellant has been convicted for life imprisonment for the charge of murder.  Present appeal of the appellant was reported to be beyond time by 150 days.  We have perused the delay condonation application and the affidavit appended therewith.  In our opinion ground shown in the affidavit is sufficient and therefore, we condoned the delay of 150 days in filing the appeal.  

Delay condonation application is allowed as above and appeal is treated to be a regular appeal. 

Office is directed to allot a regular number on this appeal.
