Challenging the recovery citation for recovery of Rs.19873 + other dues in respect of road tax qua tempo/taxi vehicle which is registered as U.P.63 D-9474, present writ petition has been filed.
By means of the present writ petition, the petitioner has prayed that the amount sought to be recovered, may be permitted to pay the dues in installments.
By the order dated 30.04.2013, the petitioner was directed to deposit a sum of Rs.10,000/- to show his bonafide. Supplementary affidavit has been filed today stating therein that the petitioner has deposited the aforesaid amount on 3rd May, 2013. Copy of the receipt has been enclosed therein.
Having heard the learned counsel for the petitioner and learned standing counsel, the writ petition is disposed of by providing that the petitioner may deposit balance amount within a period of six weeks. Recovery proceedings for the balance amount for the aforesaid period shall remain stayed.
It is made clear that if the petitioner fails to make the deposit as stipulated above within stipulated time, it shall be open to the respondents to proceed against the petitioner in accordance with law for recovery of the balance amount.
