Petitioner has approached this Court to direct the respondents to consider the case of petitioner for regularization on the basis of recommendation made by the District Magistrate, Fatehpur on 20.11.2012.
Under U.P. District Offices Collectorate Ministerial Service (Second Amendment) Rules, 2011, particular provision has been provided for wherein it has been clearly provided therein under Rule 5, providing therein that 30% of the vacancies in question shall be filled up through selection committee from amongst Assistant Wasil Vakil Navish who have worked satisfactorily for at least four fasli years on the first day of the year in which the selection is made.
There is no reason to believe that whenever exercise is to be undertaken the exercise will be in consonance with the Rules. Coupled with this, as of now this Court proceeds to take judicial notice of the fact that the State Government has already imposed ban. In view of this prayer as has been made by the petitioner to direct the respondents to regularize the petitioner cannot be accepted.
Consequently, present writ petition is dismissed. In case any exercise is undertaken and in case petitioner feels that his grievance remains to be redressed then he can approach to appropriate forum or this Court in accordance with law
