Some extremely wild allegations were made by the petitioners against Presiding Officer of the court of Additional District Judge/ Special Judge, Siddharth Nagar. Transfer Application No.34 of 2013 was filed before District Judge, Siddhartah Nagar, which was rightly rejected on 23.03.2013. It was not at all advisable for the District Judge to call for the comments on the frivolous transfer application. It is mentioned in the order by the District Judge that petitioner stated that her husband had heard from the opposite parties that they had settled the matter with the judge concerned. The court wonders why on such a wild allegation comments were called for. If a person has won over a judge then he keeps the said fact a closely guarded secret until he has obtained order in his favour. Even a fool in such situation will not tell any one else that he has settled the matter in advance with the judge concerned. Learned District Judge must be careful in future. There is no such requirement that on every transfer application however scandalous, vexatious and contemptuous it may be, comments must be called for.

Writ Petition is dismissed.

Office is directed to send a copy of this order to the District Judge, Siddharth Nagar immediately.
