This petition seeks initiation of proceedings under the Contempt of Courts' Act 1971 against the respondent-contemners for willful disobedience of judgment dated 04.7.2012 rendered in Writ Petition No.5929(SS) of 1994, Hari Har Prasad Pandey v. U.C.O. Bank and others (Annexure-1), read with judgment dated 17.4.2013 rendered in Review Petition No.330 of 2012.
Issue notice to respondent-contemner no.1 only at this stage, by way of ordinary post, Registered A.D. Post and Speed Post, returnable on 13.9.2013.
The said respondent is required to show to the court as to under what circumstances the petitioner has not been reinstated despite specific direction of this court.
Steps be filed within four days from today. If the steps are not filed within the time provided therefor, this petition would be deemed to have dismissed, without reference to Court.
List on 13.9.2013.
Let counter affidavit be filed by the next date of listing.
It is made clear that in case the counter affidavit/affidavit of compliance is not filed before the next date of listing, costs amounting to Rs.5000/- (five thousand only) shall be imposed.
It is further made clear that in case the order is not complied with, the respondent-contemner shall be required to show cause as to why proceedings under the Contempt of Courts' Act be not initiated against him.
