Hon'ble Rajes Kumar,J.

Sri H.S. Srivastava, learned Standing Counsel, submitted that despite the letter being written, he could not get any response from the District Inspector of Schools, Saharanpur and, therefore, counter affidavit could not be filed. He prays for further time to file counter affidavit. On 13.5.2013, this Court has granted learned Standing Counsel four weeks and no more to file counter affidavit and further observed that in case if the counter affidavit will not be filed, the District Inspector of Schools, Saharanpur shall appear in person on the next date fixed. Neither counter affidavit has been filed nor the District Inspector of Schools, Saharanpur has been present. As prayed, four weeks further time is allowed to file counter affidavit on the cost of Rs.5,000/-.

List on 19.8.2013. In case if the counter affidavit will not be filed, the District Inspector of Schools, Saharanpur shall appear in person on the next date fixed.

Certified copy of this order be provided to the learned Standing Counsel.
