This petition seeks initiation of proceedings under the Contempt of Courts' Act 1971 against the respondents for willful disobedience of order dated 07.7.2011 rendered in Writ Petition No.3865(SS)/2011.
Vide the order at issue, the Joint Director of Education, Faizabad Region, was required to consider and decide statutory appeal of the petitioner.
Sri Lalit Shukla has informed the court that the appeal has been decided vide order dated 22.6.2013. Affidavit of compliance has not been filed, for which time is sought.
This court finds that there is substantial delay in compliance of the order and even in filing affidavit of compliance, because notice in this case was issued in June 2012.
On request of Sri Shukla, list this case on 25.7.2013, however, subject to payment of Rs.5000/- (Five thousand only) as costs to be deposited in Oudh High Court Bar Association Library Fund. The amount shall be recovered from salary of the officer/official, who is found responsible for causing delay.
