Learned counsel for the petitioner filed Writ Petition No.3518(SS) of 2013. Respondents were directed not to relieve the petitioner, if the petitioner had not been relieved.
The first order to that effect was passed on 19.6.2013 (Annexure-1) and thereafter has been continued till date. Despite such directions, petitioner has been relieved by the respondents with effect from 01.7.2013, thereby showing willful disobedience of the orders passed by this court.
Issue notice to respondents.
Sri S.S. Sabi, learned State Counsel accepts notice on behalf of respondents and prays for time to file counter affidavit/affidavit of compliance.
List on 06.8.2013.
It is made clear that in case the counter affidavit/affidavit of compliance is not filed before the next date of listing, costs amounting to Rs.5000/- (five thousand only) shall be imposed.
It is further made clear that in case the order is not complied with, the respondent nos.1 and 2 shall be required to show cause as to why proceedings under the Contempt of Courts' Act be not initiated against them.
