Heard Sri T.B. Pandey, learned counsel for the applicants and learned AGA for the State.

It is contended by the learned counsel for the applicants that  opp. party No.2 is the cousin brother of applicant No.1 and malicious complaint has been filed by him against the applicant No.1 and his family members. He further submits that  earlier also applicant No.1 had lodged a complaint against opp. party No.2 for the offence under Section 323,,504,419,420,466,468 I.P.C. and the same is pending before the competent Court.

Notice on behalf of opp. party No. 1 has been accepted by the learned AGA.

Issue notice to opp. party No.2 returnable within four weeks at the address given in the petition.

Opp. party No.2 may file counter affidavit within four weeks. Learned A.G.A. may also file counter affidavit within the same period. Rejoinder affidavit may thereafter be filed within two weeks.

List immediately after expiry of the aforesaid period before the appropriate Bench.

Till the next date of listing, further proceedings of complaint case No.688 of 2012, under Sections 147,323,452,504,506,477 I.P.C., Police Station Madiyahu, District Jaunpur, pending in the Court of Additional Chief Judicial Magistrate-Ist, Jaunpur (Samiullah Vs. Hafiz @ Nanhe and others)  shall remain stayed against the applicants.
