Allahabad High Court
Aslam @ Chanu (Third Bail) vs The State Of U.P. on 1 July, 2013
Bench: Ajai Lamba

HIGH COURT OF JUDICATURE AT ALLAHABAD, LUCKNOW BENCH

?Court No. - 26

Case :- BAIL No. - 846 of 2013

Applicant :- Aslam @ Chanu (Third Bail)

Opposite Party :- The State Of U.P.

Counsel for Applicant :- Prashansa Singh

Counsel for Opposite Party :- Govt.Advocate

Hon'ble Ajai Lamba,J.

This is third application for bail.  The first application for bail was dismissed by Coordinate Bench vide order dated 24.5.2012 in following terms:

"Heard learned counsel for the accused applicant and learned counsel for the State and perused the F.I.R. and other relevant papers filed in support of the bail application.

As per FIR the complainant was traveling by vehicle Indica on 25.12.2011 at 9.00PM which was being hit by Taverra vehicle from behind which overtook the vehicle and the driver poured chilly power in his eyes and three culprits between age 32 to 35 years robbed him of Rs.7,07,650/- and 2 mobile sets by use of force. During the course the complainant was hit on the head. The culprits then tied him with the rope and leave him behind a bridge. On 1.1.2012 Rs.30,000/- have been recovered from the possession of the accused applicant. This is a case of highway robbery coupled with recovery.

Considering the facts and circumstances of the case I do not find it a fit case for granting bail. Accordingly, the bail application is rejected."

Considering the contends of the order, no ground for interference is made out.

This application for bail is accordingly dismissed.

However, keeping in view the custody period of the applicant, the trial court is directed to expedite the trial and conclude it preferably within four months from the next date of listing.  This is particularly so, because the charges were framed on 12.5.2012 and till date not a single witness has been examined.

Order Date :- 1.7.2013
