Heard learned counsel for the petitioner and Sri Rajesh Kumar Srivastava appearing for the respondents.

From the record that the present writ petition, it is apparent to the petitioner has already filed Original Suit No. 1174 of 2012 which is pending before Civil Judge, Senior Division, Ghaziabad. Petitioner has also filed a temporary injunction application which is also said to be pending.

In view of the aforesaid, we dismiss the present writ petition with liberty to petitioner to seek his remedy in the civil suit itself.
