Citation : 2013 Latest Caselaw 7278 ALL
Judgement Date : 3 December, 2013

Allahabad High Court
Sirdar vs Deputy Director Of ... on 3 December, 2013
Bench: Sibghat Ullah Khan

HIGH COURT OF JUDICATURE AT ALLAHABAD, LUCKNOW BENCH

?Court No. - 21

Case :- CONSOLIDATION No. - 727 of 2013

Petitioner :- Sirdar

Respondent :- Deputy Director Of Consolidation, Distt.Sitapur & Others

Counsel for Petitioner :- Raj Kumar Verma

Counsel for Respondent :- C.S.C.

Hon'ble Sibghat Ullah Khan,J.

The argument of the learned counsel for the petitioner is that boaring does not belong to the petitioner and lower revisional court has wrongly mentioned it.  It has further been argued that plot no. 200/1 was exclusive original holding of the petitioner, part of which has been given by the D.D.C. to respondent no. 3.  It has also been argued that respondent no. 3 had made his claim upon plot no. 376.  In order to appreciate the controversy properly, it is necessary to look into the map.  Let map prepared after the C.O., S.O.C. and D.D.C. stage shall be filed along with the supplementary- affidavit.  Put up as fresh on 09.12.2013.

However, pendency of this writ petition shall not be treated to be stay of any sort.  Petitioner is restrained from seeking adjournment of any proceedings, postponement of any action or any other benefit due to mere pendency of this writ petition.

Order Date :- 3.12.2013
