Against the cancellation order passed by the Yamuna Expressway Industrial Development Authority dated 2.11.2012, an statutory remedy is available to the petitioner under Section 41(3) of U.P. Urban Planning and Development Act, 1973 (herein after referred to as the Act, 1973) which have been made applicable under the U.P. Industrial Area Development Act, 1976.

In view of the aforesaid, the writ petition is dismissed with liberty to the petitioner to approach the State Government.

Interim order, if any, stands discharged.

However, in the facts and circumstances of the case, it is provided that if an application under Section 41(3) of the Act, 1973 is made within two weeks from today before the State Government by the petitioner along with certified copy of this order then no objections with regards to delay, if any, in filing of the application shall be entertained.
