           Pursuant to the Order dated 15th July, 2013, the case has been put-up today as a fresh case.

        Learned Standing Counsel appearing for the respondent No. 1 to 4 states that instructions, as mentioned in the Order dated 15th July, 2013, have been received by him, and as per the instructions, the Stay Application filed by the petitioner along with the Appeal before the Divisional Commissioner concerned was considered by the Divisional Commissioner concerned on 1st August, 2013,  and an interim order staying fresh allotment of the Fair Price Shop in question till the date  fixed, namely, 29th August, 2013, has been passed.

        In view of the statement made by the learned Standing Counsel on the basis of the instructions received by him, Sri P. R. Maurya, learned counsel for the petitioner states that the petitioner does not want to pursue the Writ Petition any further and, therefore, the same may be dismissed as withdrawn without prejudice to the right of the petitioner to pursue the Appeal filed by him before the Divisional Commissioner concerned.

       In view of the statement made by the learned counsel for the petitioner, the Writ Petition is dismissed as withdrawn without prejudice to the right of the petitioner to pursue the Appeal filed by him before the Divisional Commissioner concerned.
