Sri Jain, learned counsel for the petitioner has moved an application for recall of the order dated 3.4.2013 by which the petition was dismissed probably for the reason that it has been rendered infructuous with the passage of time on the ground that the petition has not become infructuous and he had not sent illness slip for adjournment which was not pointed out.
