Petitioner claims to be a clerk in the Vivekanand Ucchtar Madhyamik Vidhyalaya, District Gonda. In the said institution when the salary of the staff was not being paid a writ petition No. 1977 (M/S) of 1998 Committee of Management Vivekanand Ucchtar Madhyamik Vidhyalaya Vs. District Inspector of Schools was filed. It was disposed of vide order dated 4.9.1998.

In pursuance of the aforesaid order the salary of the staff of the institution from July 1999 was paid. However, the salary of the petitioner from March till 24.7.1999 was not paid. He therefore filed this writ petition wherein by interim order dated 23.9.1999 petitioner's representation regarding payment of salary for the period March to 24.7.1999 was directed to  be decided. In pursuance thereof the Basic Shiksha Adhikari vide order dated 3.8.2012 has written to the Manager of the institution to immediately arrange for making payment of arrears of salary to the petitioner from March 1999 to 24.7.1999 but inspite of that arrears of salary has not been paid.

In view of the above, respondent no. 4 is directed to make payment of arrears of salary for the above period to the petitioner within a period of one month from today or to show cause as to why the order of the Basic Shiksha Adhikari dated 3.8.2012 is not being complied with.
