The University has not filed counter affidavit since 2009. A prayer for adjournment has been made to enable the counsel to prepare paper book of the writ petition.

It appears from the order sheet that on 30.11.2012 counsel for the University was granted a month's time and no more for filing counter affidavit but no counter affidavit has been filed. 

In view of the above, there is no justification for allowing any further time to the University counsel to file counter affidavit or to get his paper book prepared. It is the duty of the University to supply the paper book to the counsel engaged.

In the above circumstances, as the University is not filing counter affidavit, Registrar of Lucknow University, Lucknow is directed to produce the record relating to appointment of the petitioner as well as regarding the 6 other employees as mentioned in paragraph 15 of the writ petition on the next date. 

List on 16th May 2013.
