Heard learned counsel for the petitioner and learned Additional Government Advocate.

The petitioner, who happens to be complainant of Case Crime No.2 of 2013 under section 304 I.P.C. police station Mishrikh, district Sitapur has approached this Court by means of this writ petition with the prayer for issuance of a Writ Mandamus commanding the opposite parties to transfer the investigation from police station concerned to some other police station since he apprehends that the investigation is not being done fairly and properly in its correct perspective.

Petitioner has preferred a representation to the the Superintendent of Police, Sitapur,  on 04.04.2013, a copy of which has been annexed as Annexure 3 to the writ petition but to no avail. Learned counsel for the petitioner submits that the petitioner confines the prayer made in the petition to the extent that a direction may be issued to Superintendent of Police, Sitapur to dispose of the representation so preferred by him with respect to transfer of the investigation from police station concerned to some other police station.

Since the prayer so made is innocuous in nature, we direct the Superintendent of Police, Sitapur to consider and dispose of the representation so preferred by the petitioner dated 04.04.2013(annexure 3) by a speaking and reasoned order within ten days form the date of production of a copy of this order along with a copy of the said representation before the Superintendent of Police, Sitapur.

Subject to above observations/directions, the writ petition is finally disposed of.
