The petitioner has challenged the award of the Presiding Officer dated 17.2.2012 by which he has directed for the reinstatement of the respondent. The respondent claimed that he was employed during the period 27.3.1990 to 9.3.1998. However, he was not able to adduce any evidence in this regard. To the contrary, it is the case of the petitioner that the respondent was never his workman.
The petitioner is able to make out a prima facie case which requires consideration.
Respondent is represent by Sri Rajesh Tiwari, Advocate. He prays for and is granted two weeks time to file counter affidavit. Rejoinder affidavit may be filed within two weeks thereafter.

Meanwhile, the operation of the award dated 17.2.2012 passed by the Presiding Officer in reference case no. 103 of 2002, Sri Mukesh Kumar vs. Manager, M/s. Indo Piston Industries 6/12 Bhairo Park, Belangaj, Agra shall remain stayed.
