Learned counsel contends that under the Cane Department in the Government of U.P., Federal Special Fund Establishment has been set up. The petitioners are employees of Federal Special Fund Establishment.

Federal Special Fund Establishment finances various other organizations, one of them being U.P. Cane Research Council, Shahjahanpur. While the age of retirement of other organizations funded by the petitioner-establishment has been extended from 58 years to 60 years vide impugned order dated 29.6.2012, Annexure-1, this facility has not been given to the employees of Federal Special Fund Establishment. An anomaly has been created thereby, for which no reason has been assigned in Annexure-1.

Sri Pankaj Patel, learned State Counsel, has put in appearance for respondents. He prays for and is granted two weeks' time to file counter affidavit.

Rejoinder affidavit, if any, be filed within two weeks thereof.
