It has been asserted on the basis of pleadings in para 3 of the writ petition that impugned order dated 04.7.2012, Annexure-1, was passed without giving an opportunity of hearing to the petitioner.
I have taken note of the fact that respondent no.6 preferred Civil Writ Petition No.2024(SS) of 2012, which was disposed of vide order, Annexure-9, directing the respondents to examine the grievance of the petitioner raised by means of representation and decide the same after affording opportunity of hearing to all concerned. Consequently, order Annexure-1 has been passed which notices that all the relevant parties have been given opportunity of being heard.
The petitioner, as noted above, asserts otherwise.
Sri P.K. Singh Bishen, Advocate has put in appearance for respondent no.4.
Sri Rahul Shukla, learned Standing Counsel has put in appearance for respondent nos.1,2 and 3.
Respondent nos.5 and 6 be served by way of notice, returnable in three weeks.
It is hereby made clear that in case assertion made on behalf of the petitioner is found to be misleading or incorrect, the petitioner shall be burdened with costs amounting to Rs.7000/-(seven thousand only).
