The petitioner has been appointed as Village Development Officer in the year 1999. In the year 2012 in the general election he was posted as Presiding Officer. It appears that due to the irregularities, the petitioner has been suspended and the inquiry is going on. The grievance of the petitioner is that he has not been paid subsistence allowance.
When the matter came up for consideration on 19.10.2012, learned counsel was directed to seek instruction that why the subsistence allowance has not been paid to the petitioner.
Ms. Suman Sirohi, learned Standing Counsel states that despite the letter being written to the District Magistrate, Kanpur Nagar and Chief Development Officer, Kanpur Nagar no instruction has been received.
In view of the above, the Court proposes to issue an interim mandamus. The respondent no. 2 is directed to pay subsistence allowance to the petitioner from April, 2012 or to show cause within a period of 10 days.
