Heard learned counsel for the revisionist and learned A.G.A for the State.
By this revision application, the revisionist has challenged the order dated 15.9.2012 passed by the Judicial Magistrate, Garh Mukteshwar, Ghaziabad,whereby the application of the revisionist, under section 156(3) Cr.P.C, has been rejected.
I have perused the order passed by the court below as also the application under section 156(3) Cr.P.C.
A perusal thereof reveals that between the parties there was a civil dispute pending with respect to the land relating to Ganga Talkies. It appears that certain sale -deeds were executed by the prospective accused in violation of some injunction order. The court below found that the dispute between the parties was of civil nature, and relying on judgement of the apex court in the case of Indian Oil Corporation Vs. M/s N.E.P.C, India Limited, (2006) 6 SCC 736, rejected the application. I do not find any illegality in the order passed by the court below.
The revision application is dismissed.
