Heard learned counsel for the petitioner and learned Standing Counsel.

By means of the present writ petition, the petitioner is challenging the appointment of respondent no. 5 on the post of Mini Aaganwabari Karyakatri and the order dated 31.7.2012 passed by the Bal Vikas Priyojna Adhikari, Kaptanganj, Kushinagar on the representation of the petitioner in pursuance of the direction given by this Court dated 4.7.2012 in Writ Petition No. 31664 of 2012.

The main contention of the petitioner is that the last date of submission of the application as well as the entire documents was 29.7.2010. Admittedly, the respondent no. 5 has submitted the income certificate on 31.8.2010 that is subsequent to 29.7.2010. That too was on the basis of the income of the father. Annexure-2 is the income certificate, which is dated 31.8.2010 wherein instead of the name of the husband, the name of the father Ram Nath has been shown. The advertisement is Annexure-1. The last date of furnishing the application was 29.7.2010. She also submitted the domicile certificate of Pradhan while it should have been issued by the Tehsildar and the same was filed at the time of hearing much after the last date of filing of the application.

Learned Standing Counsel accepted notice on behalf of respondent nos. 1 to 4. Issue notice to respondent no. 5 returnable at an early date.

List on 20.11.2012. By that time all the respondents may file counter affidavit.
