Nobody is present to press the writ petition even in the revised reading of the cause list.

This writ petition has been filed with a prayer to quash the First Information Report dated 04.03.2011 registered as Case Crime No. 169 of 2011, under Sections 498-A, 323, 504, 506 I.P.C. and ¾ Dowry Prohibition Act, Police Station Rudhauli, District Basti.

We have heard learned A.G.A. and perused the records.

This matter was referred to the Mediation and Conciliation Centre, High Court, Allahabad for mediation under order of this Court dated 16.03.2011.

Report of the Mediation Centre dated 16.09.2011 is on record. It is reported that the parties are not willing for mediation. Mediation has, therefore, failed.

We have gone through the First Information Report. It does disclose cognizable offence. In view of the aforesaid, no case for quashing of the First Information Report is made out.

The present writ petition is accordingly dismissed.

Interim order, if any, stands discharged.

Learned A.G.A. is directed to forward a copy of this order of the Senior Superintendent of Police/Superintendent of Police concerned, who in turn shall ensure that investigation is completed with due diligence, if not already completed.
