Re: Modification Application No. 259994 of 2012.

This is an application praying for extension of time to deposit the loan amount.

The writ petition filed by the petitioner, challenging the recovery, was disposed of on 19.01.2011, directing the petitioner to deposit the entire loan amount in 6 installments.  Petitioner has deposited the substantial amount in 4 installments and however, it appears that petitioner could not deposit the balance amount of Rs.80,575, as the last two installments.  Learned counsel for the petitioner, seeks extension of time to deposit the entire balance amount.

Considering the facts and circumstances of the present case, the present application is disposed of with the direction to petitioner / applicant to deposit the entire outstanding amount with interest upto 31st December, 2012.

With the aforesaid observations, the present application disposed of.

Order Date :- 8.10.2012
