Applicant has filed this application for bail in Case Crime No. 231 of 2010 under Section 3(1), Uttar Pradesh Gangsters and Anti-Social Activities (Prevention) Act, 1986 (for short 'the U.P. Gangsters Act') Police Station Rudauli, District Faizabad.

Learned counsel for the applicant contends that the applicant was initially implicated under Section 392 I.P.C.  Later, the case was converted to one under Sections 395 and 398 I.P.C.  Under the said provisions, the applicant has been released on bail by the lower court vide order dated 24.9.2010.  At this stage, applicant was taken in custody on 27.5.2012 after being implicated under the U.P. Gangsters Act.

Learned counsel for the State prays for time to get exact sequence of events as to when the U.P. Gangsters Act was invoked when the chargesheet was filed and whether the applicant abused the concession of bail by not appearing.

List after two weeks.
