Sri Rakesh Kumar Pandey, Advocate has produced today requisite instruction received from Principal DIET, Sarnath, Varanasi.  As per instructions so received, the petitioner's candidature has been non-suited on account of reshuffling being made as one Asutosh Ratan Pandey, whose merit was 217.63 and who was also from physically handicapped category had been left out from being considered and subsequently on scrutiny being made, his claim has been considered and he has been included in the merit list and the petitioner whose  merit is 200.11 has been excluded from the zone of  consideration. Once such is the factual situation, then it would be much more appropriate that a detailed counter affidavit is filed, so that the petitioner may be in a better position to rebut the same.

In view of the above let a counter affidavit be filed through Sri Rakesh Kumar Pandey, Advocate within a period of three weeks. Rejoinder affidavit may be filed within next one week.

List this case thereafter on 03.01.2013.
