The grievance of the petitioner is that there being only one post of clerk in the institution, the same is required to be filled by way of promotion in view of the judgment of this Court in the case of Jai Bhagwan Singh Vs. District Inspector of Schools, Gautam Buddha Nagar and others reported in 2006 (3) UPLBEC, 2391. He, therefore, opposes the order of District Inspector of Schools where under a direction has been issued for appointment on compassionate ground of one Shri Ashish Kumar s/o Shri Awdhesh Kumar against the same post.

In view of the aforesaid, operation of the order impugned dated 22.05.2012 passed by the District Inspector of Schools shall remain stayed. However, it is provided that it shall be open to the District Inspector of Schools to adjust respondent no. 8 against any other vacancy, which may be available in the same institution or any other vacancy, which may be available in any other aided and recognised institution of the district.
