Heard learned counsel for the petitioner,  learned A.G.A. for the State and perused the record.

The present writ petition has been filed for quashing the impugned F.I.R. of Case Crime No. 83/2012 under section 409 I.P.C., P.S. Baghrai, District-Pratapgarh.

Learned counsel for the petitioner submits that earliet arrest of the co-accused was stayed by this court on the ground that they were not held guilty in the inquiry conducted by the Punchayat. It is submitted by the counsel for the petitioner that now another inquiry has been initiated by the Commissioner and the said inquiry still pending.

Considering  the case, arrest of the petitioner shall remain stayed in Case Crime No. 83 of 2012 under section 409, Police Station Baghrai, District-Pratapgarh.

List in the month of August for final hearing .
