This petition has been filed under Section 482 Cr.P.C. with the prayer that order of summoning dated 21.1.2012 issued by the Judicial Magistrte-II, Lucknow, in Complaint Case No.3842 of 2010, under Sections 120B/420/406/467/468/471/384 I.P.C., P.S. Bazar Khala, District Lucknow, be quashed.

It has been pointed out that the petitioner earlier approached this court by way of filing Criminal Misc. Case (u/s 482 Cr.P.C.) No.845 of 2012 titled Harish Kannaujia v. State of U.P. & ors., which was dismissed vide order dated 15.3.2012.

Learned counsel contends that the same Bench (Ashwani Kumar Singh, J.) has issued notice in the case of main accused in Criminal Misc. Case No.1546 of 2012 titled Mohd. Farhan v. Km. Rashmi Srivastava & ors, vide order dated 04.5.2012.  The operation of summoning order has also been stayed.  In this regard, reference has been made to Annexure 17.

It would be judicially appropriate for the same Bench to here this matter.

Let this case be listed before the same Bench after obtaining permission from the Hon'ble Chief Justice/Senior Judge.
