Learned Standing Counsel filed the compliance affidavit sworn by Sri G.D. Yadav, District Programme Officer, Allahabad annexing the copy of the report of the Director, Bal Vikas Sewa Evam Pushtahar, U.P., Government, Lucknow. It appears that in the inquiry, he has recorded the statements of various persons. The copies of such statements have not been annexed along with the report. From the perusal of the report, it appears that he himself has not reached to any final conclusion and left it on the Court to decide the issue.

In view of the above, it would be necessary to look into the records of the case as well as the statements recorded during the inquiry proceeding.

Learned Standing Counsel is directed to file the copies of the statements recorded in the inquiry proceeding conducted by the Director, Bal Vikas Sewa Evam Pushtahar, U.P., Government, Lucknow and also produce the entire records of the case on the next date fixed. It appears that the direction given by this Court vide order dated 16.4.2012 has not been complied with. The Director, Bal Vikas Sewa Evam Pushtahar, U.P., Government, Lucknow has not shown the cause that why he has asked the Joint Director to make an inquiry while the direction was given to the Director, Bal Vikas Sewa Evam Pushtahar, U.P., Government, Lucknow to make an inquiry. Learned Standing Counsel is directed to file reply in this regard also.
