In present writ petition order dated 5-10-2005 sought to be quashed by which original suit No. 647 of 2004 has been decided on the basis of compromise.
It has been contended by the learned counsel for the respondent that an application under section 151 C.P.C. had already been moved before the lower court in 2006. It has further been contended that petition under section 151 has already been disposed off by the lower court.
Sri Mukesh Sherma, advocate appearing on behalf of the petitioner stated that Sri H.K. Bhatt, has become S.C., hence he sought adjournment of the case.
Learned counsel for the respondent pointed out that there is more than one advocate for the petitioner, so it is not good ground for adjournment.
The respondent is directed to file an affidavit to the effect that the petition u/s 151 C.P.C. has been disposed of in the lower court.
Affidavit may be filed within two weeks.
List for hearing of this petition in the week commencing from 9th July, 2012.
