This writ petition has been filed by the petitioner against the order dated 22-08-2008 passed by the learned  Commissioner, Lucknow. In this order a direction is given to the Sub-Divisional Officer, Sadar to decide the matter of Fair Price Shop in the light of direction given in the impugned order.

In pursuance of order of remand, Sub-Divisional Magistrate, Sadar decided the matter of fair price shop vide its order dated 28th September, 2008. The said petition has been filed in the month of December, 2008, but no relief has been sought in respect of the final order. The copy of the final order is also attached with the writ petition, wherein this Fair Price Shop is allotted to Smt. Rekha Rani (Respondent No. 4) and her allotment was found in order. The agreement in favour of petitioner stands automatically cancelled. Consequently, supplies of essential commodities and food grain was stopped with immediate effect.

In view of the final order passed, this petition become infructuous. The petiltion is dismissed with the liberty to the petitioner to file fresh petition if he has been  so advised.

The writ petition is  accordingly disposed of.

Certified copies may be returned to the petitioner on presentation of  proper application in this regard.
