Heard learned counsel for the petitioner and learned Additional Government Advocate.
Under challenge in the instant writ petition is FIR relating to case Crime No. 194/2012, under Section 386, 504 and 506 I.P.C., Police Station Kotwali, District Sitapur.
Learned Additional Government Advocate has argued that in same case crime number the following order has been passed in writ petition no. 3318 of 2012(MB) :-
"We have gone through the FIR, which discloses commission of cognizable offence, as such, the same cannot be quashed.
The writ petition is misconceived and is accordingly dismissed.
However, it is privided that if the petitioner surrenders and moves application for bail, the same shall be considered and disposed of by the courts below expeditiously."
This writ petition is also disposed of in terms of the above order.
