Heard learned counsel for the applicant, leaned A.G.A. for the State and perused the F.I.R. and other relevant documents on record.

The applicant is involved in Case Crime No. 287 of 2011, under Section 302, 201, 404, 120B I.P.C., Police Station-Arwal, District-Hardoi.

It has been submitted by the learned counsel for the applicant that Raju has already been admitted to bail on 20-03-2012. The case of the present applicant - Pusey is on identical footings. The case is based on circumstantial evidence. Except the statement of the co-accused there is no other evidence.

Learned A.G.A. has opposed the prayer for bail.

Considering the facts and circumstances of the case after perusing the record and considering the nature of the allegations, arguments advanced by the learned counsel for the parties and without expressing any opinion on the merit of the case, I find it to be a fit case for bail.

Let applicant Pusey, involved in the aforesaid case, shall be released on bail on his furnishing a personal bond with two sureties of like amount to the satisfaction of the court concerned.
