Heard learned counsel for the applicant and the learned A.G.A.

It is contended by learned counsel for the applicant that the FIR of this case has been lodged on 21.5.2011 at 12.05  P.M.  in respect of the incident allegedly occurred 27.4.2011 at P.S. Nawabganj, District Gonda. It is alleged that the daughter of the first informant namely Km. Kiran aged about 16 years has been kidnapped by co-accused Rakesh. The allegation against the applicant  and two other co-accused that they also provided cooperation in the kidnapping of the girl. The kidnapped girl has not been recovered. The applicant is father of the co-accused Rakesh. He is having no concerned with the case of kidnapping even no specific allegation has been made against the applicant. The case of the applicant is distinguishable with the case of co-accused Rakesh. The applicant is in jail since 27.4.2011.

In view of the facts, circumstances of the case, submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.

Let the applicant Radhey Shyam involved in case crime no.  148 of 2011 under Sections  363, 366 I.P.C., P.S. Nawabganj, District  Gonda  be released on bail on his furnishing a personal bond and two heavy sureties each in the like amount to the satisfaction of the Court concerned with the conditions:

1.that he will not temper with the evidence and

2.he shall report to the court of C.J.M. concerned in the first week of each month to show his good conduct and behaviour till conclusion of the trial.
