Heard learned counsel for the petitioner, Sri Shivam Yadav for respondent no. 2 and learned AGA for the State-respondents.

This revision has been filed against  order dated 21.4.2012, passed by Additional Chief Judicial Magistrate, Hapur, Ghaziabad, in Case No. 272 of 2012 (State Vs. Ravi and others), registered under sections 302 and 307 IPC, at PS Hapur Nagar, District Panchsheel Nagar, whereby non-bailable warrant has been issued against the revisionist on an application filed by the investigating officer.

Relying on (2000) 10 SCC 438: State through CBI Vs. Dawood Ibrahim Kaskar and others, Learned counsel for the revisionist contends that  in an identical matter, i.e. Crl. Revision No. 2827 of 2010, another Bench of this Court has passed an order dated 27.7.2010.

Issue notice to the respondents, who may file counter affidavit within three weeks. Rejoinder affidavit, if any, may be filed within two weeks thereafter.

List immediately thereafter along with the record of Crl. Revision No. 2827 of 2010: Manoj @ Ase and others Vs. State of U.P.

Till the next date of listing, no coercive steps shall be taken against the revisionist pursuant to the impugned order dated 21.4.2012 passed by Additional Chief Judicial Magistrate, Hapur, Ghaziabad in Case No. 272 of 2012 (State Vs. Ravi and others).

It is made clear that the investigation shall go on.
