This petition was never heard by me earlier on merits. It was directed to be listed before appropriate Bench vide my order dated 23.9.2011.

Despite the above order, it has again been listed before me.

The matter is arising out of a suit which is pending in the court below.

I am sitting in a different jurisdiction, i.e. company, testamentary and tax.

Accordingly the matter is released for listing before the appropriate Bench, showing the name of Sri Pawan Kumar as counsel for respondent no. 2, who has filed his appearance today which is taken on record.
