Hon'ble Ajai Lamba,J.

1.     Applicant Indra Pal prays for bail in Case Crime No. 822 of 2011  under Section 364,  I.P.C. Police Station Bilgram, District  Hardoi.

2.     Learned counsel appearing for the applicant at the outset contends that the case of the applicant is similar to that of  co-accused Sukhwasi who has been allowed bail by virtue of order dated 02.5.2010 in case Bail No.1129 of 2012.  Applicant is in jail since 13.10.2011.

3.     Learned counsel appearing for the respondent-State does not dispute the facts as asserted.

4.     I have considered the contention of the learned counsel for parties and gone through the record.

5.     Considering the custody period of the applicant since 13.10.2011 and also taking note of the fact that F.I.R. was lodged as a consequence of order passed by the Magistrate under sub-Section (3) of Section 156 Cr.P.C., 1973, this application for bail of applicant Indra Pal is allowed.

6.     Bail to the satisfaction of the Court concerned.
