Grievance of the petitioner is that order  dated 20.5.2010 passed by the Bench consisting of Hon. Sunil Ambwani,J. and Hon. K.N. Pandey,J.  has not been complied with. The court  by a detailed  order  had  directed with the modification of the interim order  dated 13.8.2007, to the extent that it will be open to the Board to take a decision, to harmonise and to rationlise the Rules so as  to avoid any discrimination between the direct  recruits and promotees for being considered for promotion on the criteria of merit, to Category-I post.  It will be open  to the respondent, thereafter  ( after obtaining  clarification from the Board), to proceed with the promotions in accordance  with  the Regulations.

Since  the matter has  been heard at length  by the aforesaid Bench consisting of Hon. Sunil Ambwani,J. and Hon. K.N. Pandey,J. it would be appropriate  to direct to list  this case  before  that Bench.

List before the appropriate Bench.
