Heard learned counsel for the applicant and learned A.G.A for the State and perused the record.
The prosecution case is that from the trouser of the applicant, 275 grams of charas was recovered. It has been contended that the recovery is below commercial quantity and that the applicant has been falsely implicated. It has also been contended that the applicant has no criminal history and has never been involved in any criminal activity.
Learned A.G.A opposed the bail, but could not dispute that the recovered quantity is below commercial quantity and that the applicant has no criminal history.
Considering the fact and circumstances of the case, without expressing any opinion on the merits of the case, I find it to be a fit case for bail.
Let the applicant Vikram Singh involved in case crime No. 278 of 2012, under section 18/20 of N.D.P.S Act, Police Station Goverdhan, District Mathura be released on bail on his furnishing a personal bond with two reliable sureties each in the like amount to the satisfaction of the court concerned.
